Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") govern access to and use of the website www.protosweb.eu (the "Site") operated by Dario Imsirović — Protos Web, trade registration in progress as Protos Web Mark23 (OIB: 23732814520), Zagreb, Republic of Croatia ("Protos Web", "we", "us").

Access to the Site, its subpages, 3D showcase, contact form, newsletter, and any interaction is permitted only after you expressly accept these Terms and the Privacy Policy via the mandatory consent screen on entry. Without that acceptance you may not use the Site or proceed further.

By accessing after acceptance you confirm that you have read, understood, and fully accept these Terms. If you do not agree, close the Site and do not use it.

2. Intellectual property and copyright

All content on the Site — including but not limited to: visual identity and branding; user interface and UX/UI design; page layout, typography, color palettes, and graphic elements; illustrations, photographs, icons, and animations; 3D models, scenes, and interactive presentations; source code, architecture, components, and databases; texts, translations, blog posts, and marketing materials; SEO metadata, structured data (JSON-LD), and technical implementations — constitutes original intellectual property of Dario Imsirović, Martina Markulin (UI design and creative contribution), and/or Protos Web, unless expressly stated otherwise.

All designs, templates, code, and creative works remain the property of their authors as sovereign, free persons and creators, regardless of trade or business registration. Business registration does not diminish or transfer copyright without an express written agreement.

All such elements are protected under the laws of the Republic of Croatia and the European Union on copyright, related rights, and intellectual property, including the Croatian Copyright and Related Rights Act and applicable international treaties.

No part of the Site shall be deemed dedicated to the public domain, nor shall any licence for use be implied without prior express written consent from Dario Imsirović / Protos Web.

3. Prohibited activities

Without prior express written permission, it is prohibited to: copy, download, reproduce, distribute, or publicly display any part of the Site; automatically collect content (scraping, crawling, harvesting); clone the design, appearance, structure, or functionality of the Site; reverse engineer, decompile, or extract source code; remove, hide, or alter copyright notices; use content for commercial, competitive, or misleading purposes; falsely claim ownership of Protos Web design, code, or brand.

Creating derivative works, adaptations, or integrating our design, code, or visual identity into third-party products, services, templates, themes, or platforms without written consent is prohibited.

4. Civil and criminal liability

Any unauthorised use, misappropriation, copying, or abuse of Protos Web intellectual property may result in full civil liability, including claims for injunctive relief, damages, disgorgement of profits, and recovery of legal costs.

Depending on severity and circumstances, the same conduct may constitute a misdemeanour or criminal offence under applicable law of the Republic of Croatia, including provisions on protection of copyright and related rights and on unauthorised use of another's intellectual or industrial property. In such cases we reserve the right to report the matter to competent authorities and pursue all permitted legal remedies.

Protos Web actively protects its copyrights and original works. Any proven infringement will be pursued to the fullest extent permitted by law.

5. Templates, components, and client deliverables

All templates, themes, components, UI kits, code libraries, design systems, wireframes, prototypes, configurations, documentation, and any other deliverable created by Protos Web for clients or internal use constitutes original intellectual property of Dario Imsirović, Martina Markulin, and/or Protos Web, unless expressly agreed otherwise in a written contract with a specific client.

A client ordering a website, application, design, or other service acquires only the usage rights clearly defined in a written contract or quote — typically: the right to use the finished project for their own business purposes. The client does not acquire ownership of underlying templates, reusable code, architecture, design system, methodology, or tools used in production, unless expressly agreed and compensated.

Clients, visitors, and third parties must be aware that unauthorised copying, downloading, adaptation, resale, or distribution of any Protos Web template, component, or client deliverable is prohibited and may result in civil and criminal liability, whether the work is shown in the portfolio or delivered to a client.

Display of work in portfolio, 3D showcase, or demo environments does not grant a licence to reproduce. Every client confirms awareness of these Terms when using the Site and/or entering a business relationship with Protos Web.

6. Portfolio, demo content, and presentations

Portfolio displays, 3D showcase, and demo experiences are for presentation only and do not grant permission to reproduce or appropriate the solutions shown.

Unauthorised copying of displayed work — including work created for clients — is equally prohibited and subject to the same legal remedies.

7. External links and third-party services

The Site may contain links to third-party websites. Protos Web does not control their content and is not responsible for their terms of use or privacy policies.

Use of third-party services (e.g. hosting, email, payments) is subject to those providers' terms.

8. Limitation of liability

The Site is provided "as is". To the extent permitted by law, Protos Web is not liable for indirect damages, downtime, or data loss arising from use of the Site, except in cases of intent or gross negligence.

Nothing in these Terms limits liability that cannot be excluded under mandatory law of the Republic of Croatia.

9. Changes to terms

We may update these Terms from time to time. The last updated date is shown at the top of this page. Continued use of the Site after changes constitutes acceptance of the updated Terms.

10. Governing law and jurisdiction

These Terms are governed by the law of the Republic of Croatia. Disputes shall be subject to the competent courts in the Republic of Croatia, unless mandatory provisions provide otherwise.
